Simon has extensive experience of a wide range of commercial litigation. He is annually noted in Chambers and Partners as a leader in commercial litigation. Simon has for over twenty years advised in relation to property issues and disputes and conducted proceedings relating to those matters. After developing a practice in Birmingham, Simon spent three years working as a solicitor at what is now known as Herbert Smith Freehills, Sydney, conducting high value commercial and insolvency litigation before returning to Birmingham and developing his current practice. Much of Simon’s work relating to property arises in the context of banking and finance disputes. In this context he is regularly involved in advising and litigation relating to charges, in particular their construction and enforcement. He also deals with all matters concerning property including: contracts for the sale of land and the enforcement of those contracts; rectification of contracts for the sale of land; ownership of property including adverse possession; rights of way and easements; boundaries. He has conducted a number of trials in which issues as to proprietary estoppel and constructive trusts have arisen in relation to property in a commercial context. He is an accredited mediator and has mediated a number of commercial disputes.
