Commercial & Chancery Litigation Profile

David undertakes a wide range of commercial work. Before coming to the Bar in 2001 he initially worked in industry and commerce after which he progressed to work in the field of international arbitration and mediation. As well as a litigation practice he also has a thriving commercial arbitral and mediation practice. He is regularly instructed to deal with contractual, property and landlord and tenant disputes and his services, given his background, are particularly sought by those involved in commercial disputes within the construction and engineering sectors. He also regularly represents financial institutions when they are trying to make recovery following mortgage default. David is a member of the Attorney General’s Panel of Counsel and he very frequently advises and represents Government departments on commercial and property matters. He also has significant experience of representing the HMRC both in the specialised tribunal of the Tax Chamber and in the Civil Court on indirect taxation matters and on complex Missing Trader Intra-Community (MTIC) civil fraud cases. David prides himself on being highly approachable and in offering well balanced and realistic advice in a clear and straightforward manner. He is always mindful of the stresses and pressures which are experienced by those dealing with disputes and strives to give every assistance to his Instructing Solicitors and their clients.

      • a company who own and lease a luxury airliner. Dispute £90,000.
      • HMRC on a MTIC Carousel Fraud in the Tax Chamber. Dispute £2.25m.
      • an engineering company in a dispute over the installation of machinery in a food processing plant. Dispute £150,000.
      • A claimant in a dispute involving family owned property and other assets. Dispute £0.5m.

      • acted as an Arbitrator in a dispute between a Premier League professional footballer and his Club. Dispute £4.25m.
      • acted as a Mediator in a partnership dispute involving a veterinary practice and hospital. Dispute £0.225m.

    • Sandwell MBC v Hensley [2007] EWCA Civ 1425

      • The Court of Appeal held that an outright possession order should have been made against a secure tenant who had been convicted of being involved in large-scale cultivation of cannabis in his home.
