Commercial & Chancery Litigation Profile

John has a first class degree from the University of Cambridge. He achieved an Outstanding at Bar School and a Distinction for the GDL. He has won numerous scholarships and awards, including the Louis Gluckstein Advocacy Prize. 

Before coming to the Bar, John worked as a Church of England minster. He became accomplished at public speaking in a variety of settings, such as weddings, funerals, assemblies and Sunday services.  He now brings this wealth of experience to his courtroom advocacy. 

John is able to assist at an early stage of proceedings by providing written or oral advice and drafting statements of case. 

He is married with a 4-year-old daughter. In his spare time, he enjoys struggling to play the piano, mountain biking and the Malvern Hills. He speaks French.

Under the supervision of John Brennan, he experienced a wide range of commercial work, with a particular focus on property, probate, contract and trusts disputes. He has recently acted in a number of construction disputes.

      • Advised on claims to invalidate a will on the grounds of:
        • incapacity, including in relation to the ‘Parker v Felgaterule’
        • undue influence and fraud
      • Advised on the enforceability of a contract in a mutual will concerning a £1.5m estate 
      • Advised on Part 64 application to determine whether an executor fulfils a condition to prove a will by appointing an attorney to obtain a grant of letters of administration 
      • Application to pass over a co-executor 
      • Applications to exhibit a full inventory and account of estates 


      • Advised on:
        • enforceability of restrictive covenants 
        • Party Wall Act dispute
        • private nuisance and harassment & acquiring a right of parking by prescription
        • forfeiture by peaceable re-entry of business lease and Commercial Rent Arrears Recovery 
        • vendor’s misrepresentation of surface water & sewer drainage
      • Drafted Defence to claim for possession of a business premises on the grounds of breach of a covenant against alienation
      • Enforced occupation rent and an order for sale of a former family home
      • Possession claims for residential assured shorthold tenancies, business tenancies and mortgaged properties. 


      • Acted for housebuilder in dispute over a sub-contract for the laying of sewage pipes
      • Drafted witness statements and acted for a housebuilder in a multi-track mediation in relation to alleged defects in a new build property 
      • Interim applications in the TCC 
      • Won appeal in small claim construction dispute. The claim had been dismissed at first instance following the judge’s misinterpretation of the information requirements under the Consumer Contract Regulations 2013

      Company, Insolvency & Bankruptcy

      • Acted for liquidator in breach of director’s duty/misfeasance final hearing
      • Acted for debtor whose identity had been stolen in contested bankruptcy petition 
      • Applications to restore dissolved companies 
      • Applications to set aside statutory demands and annul bankruptcies
      • Winding up petitions 


      • 3-day multi track trial (final dissolution accounts and enquiries)
      • Settled partnership proceedings to apply for accounts & inquiries and winding up of a partnership 
      • Advised on whether a company director could recover loans and expenses incurred on behalf of the company 

      General commercial 

      • Advised on prospects of negligent misstatement claim against a local authority for mistakenly advising that a property was listed
      • Drafted statements of case for:
        • debt claims
        • sale and supply of unsatisfactory goods 
        • negligent manufacture of goods/Consumer Protection Act 1982
        • Acted in conversion claim relating to a Rodeo Bull 


      • Applications relating to: 
        • relief from sanctions and strike out
        • setting aside default judgment  
        • pre-action disclosure 
        • expert evidence
        • vacating trial dates, extending trial estimates and transferring or re-allocating proceedings 
      • Advised on whether limitation period was reactivated by a purported acknowledgement of debt

        • a contribution claim by a co-surety
        • a negligent misstatement claim
